Newton County Court is comprised of the Juvenile Court, Magistrate Court, Probate Court, and the Judge-Superior Court. Magistrate Court exclusively exercise original jurisdiction in the probate of wills, administration of estates, appointment of guardians and involuntary hospitalization of incapacitated adults and other individuals. The court also jurisdiction over the appointment and supervision of guardians of adult persons found to be incapacitated by reason of physical or mental illness to such an extent that the adult is no longer capable of making reasonable and rational decisions concerning his or her person or of managing his or her money and property.

The County Magistrate Court handles civil claims under $15,000.00. A Magistrate Judge holds an informal hearing to listen to and decide each case. Any person may file a claim against a person or business in Magistrate Court without an attorney, or you may have an attorney represent you if you choose. Bad check issues are also administered by the probate court. The probate court judges administer oaths of office and issue marriage licenses. A marriage license is only issued if both parties are sound minded, have no living spouse from an un-dissolved prior marriage, and is not related in a degree prohibited by law. Newton County Court was the first juvenile drug court in Georgia and the first rural juvenile drug court in the nation. Through the existing drug court, they are able to offer programming to multiple levels of offenders. To date, the drug court program has successfully graduated 171 participants and is currently serving 51 youth and families. Access to these Courtrooms has now become easy, efficient, inexpensive and convenient as parties with a need to initiate and respond to court filings can do so from the comfort of their homes or offices, 24 hours a day, 7 days a week.
